Terms and Conditions

Cancellations and refunds

  1. By becoming a member of the National Portrait Gallery of Australia (ABN 54 74 277 1196) or by renewing your membership, you are automatically agreeing to these terms and conditions.
  2. The National Portrait Gallery of Australia manages the Circle of Friends (the membership program).
  3. References to the ‘Circle of Friends’, ‘we’, ‘us’, or ‘the Gallery’ are references to the National Portrait Gallery of Australia.
  4. References to ‘you’, ‘your’ or ‘member’ are references to you as an individual.
  5. By becoming a member, a legally binding contract will be formed between you and the Gallery and the following terms and conditions will form the basis of that contract, through which the Gallery will deliver a service to you as a member. Where you apply for a gift membership for someone else, we will deliver these services to the person who redeems the membership.
  6. Membership benefits and discounts are only available on the presentation of a valid membership card or, if requested, another official form of identification.
  7. The benefits associated with an active membership are available for exhibitions, public programs, purchases at the National Portrait Gallery cafe and The Curatoreum. The members discount may not be applicable on all items.
  8. Concession memberships are available to valid, means-tested concession card holders. This includes Centrelink, Healthcare, Pensioner, Veteran and full-time student card holders.
  9. Membership cards and their benefits are non-transferable.
  10. The primary membership cardholder is responsible for ensuring all details of the membership are correct.
  11. Should a member fail to comply with the Gallery’s Membership Terms and Conditions, or misuse benefits and privileges of membership, the Gallery may terminate the membership.
  12. A membership will be considered lapsed if not renewed by the due date.
  13. The expiry date of a membership cannot be suspended or extended past the expiry date stipulated on the membership record.
  14. The Gallery reserves the right to change these terms and conditions or membership benefits at any time without prior notice.
  15. When you join as a member, you will be asked for your email address and other personal details, including phone number and postal address. These details will be used to send you communications regarding your membership, including Gallery news, events and exhibitions.
  16. After the expiry of your membership, you will continue to receive email updates from the Gallery to keep you up to date with activities at the Gallery and provide you with the opportunity to renew. If you do not wish to hear from the Gallery following your expiration, you can unsubscribe from communications via the link the footer in any email from the Gallery.
  17. Members are required to present a valid membership card to book complimentary or discounted member tickets in person at the Gallery, or provide full membership details over the phone at the time of booking.
  18. All quoted membership fees are for a one-year or two-year membership subscription.
  19. The Gallery reserves the right increase the price of your membership subscription on an annual basis. You will be informed of any fee increase(s) at the time of your membership renewal.
  20. The Gallery reserves the right to amend these Memberships Terms and Conditions. On doing so, you will be informed of any changes and asked to agree to the new Terms and Conditions.
  21. The credit card information you provide us for any membership related transaction(s) is used solely for the purpose of its provision and will not be stored in any database.

Cancellations and refunds

  1. As a consumer, you have a legal right to cancel your membership (and receive a refund of the fees paid) if you change your mind or decide, for any other reason, that you do not want to continue the membership.
  2. Following the purchase of your membership, membership will be non-refundable, except within a 14-day cooling off period, in which time, you may cancel your membership for a full refund.
  3. To cancel your membership during this time, you are required to notify the Gallery in writing by contacting [email protected].

Data protection and use of personal data

  1. When you purchase membership (and during your membership subscription, from time to time) it will be necessary for us to obtain from you and process certain information (including, but not limited to, your name, address and contact details), some of which may be personal information under the purposes of the Privacy Act 1988 (Cth).
  2. Data and personal information collected from you during your membership will be used to contact you regarding Gallery offerings, programs and member news. All data collected will be handled in accordance with the Gallery Privacy Policy and the Privacy Act 1988 (Cth). You are responsible for reviewing the Privacy Policy periodically and informing yourself of changes to the Privacy Policy.
  3. We will not provide your data to any third parties without your written consent.

Events

  1. On joining the Gallery’s membership program, you will have access to a suite of events organised by the Gallery. Some events are free for members, while others require an additional cost to any paid membership fees.
  2. Events are limited by capacity, which will vary according to the nature and scope of the event. Therefore, the Gallery is unable to guarantee availability for members and advance bookings are recommended.
  3. The Gallery reserves the right to cancel, postpone or reschedule an organised event.
  4. Tickets for paid events are non-refundable, unless the event has been cancelled by the Gallery, or rescheduled to a date that is not suitable for the attendee(s).

Members subscription to Portrait magazine

  1. Members receive an annual subscription to Portrait magazine, produced by the Gallery. This publication will be delivered to members twice per year, in July and December respectively.

Free parking at the Gallery

  1. As a benefit of membership, members are entitled to claim free parking in the Gallery’s underground carpark between 10:00am – 4:00pm every day, except 25 December. To claim free parking, members must validate their ticket by presenting a valid membership card to an Experience Facilitator at the Welcome Desk.
  2. Failure to present the necessary credentials to successfully validate parking will result in the requirement to pay all necessary fees and dues for parking.

Donations

  1. The Gallery is endorsed as a Deductible Gift Recipient (DGR). It is covered by Items 1 and 4 of the table in section 30-15 of the Income Tax Assessment Act 1997.
  2. Donations of $2 or more are tax deductible, however, you should seek your own tax advice.
  3. Donations received by the Gallery are non-refundable.

  2. The membership team will aim to respond to any communication received within three business days.
  3. The membership office is open 9:00am – 5:00pm, Monday to Friday (excluding ACT public holidays).

Visiting the Gallery

  1. Members accept the Conditions of Entry of the Gallery.
  2. If a member is found in breach of the Conditions of Entry, their membership may be suspended or cancelled.

General

These Terms and Conditions set out the whole of the agreement between you and the National Portrait Gallery of Australia relating to the supply of membership services by us to you. Nothing stated by any member of our Engagement and Experience team on our behalf should be understood as a variation of these terms and conditions, or as a representation about the nature and quality of the services being offered by the National Portrait Gallery of Australia.
