General
  1. This competition is conducted by the National Portrait Gallery (ABN 54 74 277 1196) (“The Promoter”). A vote for an Eye to Eye portrait by the deadline comprises “an entry” in this competition and the person casting that online vote is “the entrant”. There is no cost or fee to enter.
  2. Information on how to enter and on the prizes form part of the Terms and Conditions. By completing an entry, the entrant accepts these Terms and Conditions.
  3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
  4. All instructions relating to the competition on this website (www.portrait.gov.au) also form part of the Terms and Conditions.
  5. The Promoter reserves the right to amend these Terms and Conditions. The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
Who can enter?
  1. To enter you must be aged 18 years or over at the time of entry
  2. You must be an Australian citizen or resident
  3. Employees of the National Portrait Gallery are not eligible for entry. 

How to enter
  1. Entries will only be accepted from 6am Saturday 14 December 2019 to 11pm Sunday 16 February 2020.
  2. Entrants must cast and submit their vote in accordance with the instructions provided online using the competition entry form.
Submission guidelines
  1. All details provided by the entrant must be true and accurate
  2. Only one entry per entrant is permitted.
  3. Entrants must include their name, email address and postcode.
Draw
  1. Winners will be drawn from all entries received on Thursday, 20 February 2020, via a random number generator. All entrants will have an equal chance of winning.
  2. Winners will be notified via email. If a winner is not forthcoming within 72 hours of the draw, the Promoter reserves the right to select another winner or not award the prize. It is the entrant’s responsibility to ensure their contact details are correct when entering the competition.
  3. No responsibility is accepted for late, lost or misdirected entries.
  4. The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into.
  5. The prize is not transferable, not refundable and not redeemable for cash and is valid only until the date of expiry indicated on the Golden Ticket.
Prize
  1. A maximum of five (5) prize winners will be drawn by chance. Each prize winner will obtain:
    • One ‘Golden Ticket’ pass consisting of:
      • Free access to all ticketed exhibitions at National Portrait Gallery for one year, for the winner and one guest per exhibition.
      • 10% off Broadbean café for one year
      • 10% off The Curatoreum at the National portrait Gallery for one year
      • Golden Ticket is valid from 9am 21 February 2020 – 5pm 1 December 2020
  2. Winners will be announced from 20 February 2020 by listing the names of the winners on the Promoter’s website and social media. The Promoter reserves the right to redeem all unclaimed prizes and dispose of them at its absolute discretion.
  3. Winners draw is final and the Promoter will not enter into correspondence with entrants regarding the results.
  4. ny winner subsequently found by the Promoter to have breached these Terms and Conditions must return any awarded prize within 30 days of a request to do so. The Promoter will not enter into correspondence regarding such a request.
Risk and Liability
  1. The National Portrait Gallery is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, in connection with the arrangement for supply of the goods by any person to the prize winners. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
  2. The Promoter, its related bodies corporate and the suppliers, agencies and other companies involved in this competition assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data.
  3. If this competition is not able to be conducted as planned for any reason (including as a result of technical failures, fraud or causes beyond the Promoter’s control), the Promoter may, in its sole discretion, cancel, suspend or change the competition and re-commence it on similar terms, subject to any directions by regulatory authorities.
  4. To the fullest extent permitted by law, the Promoter, its related bodies corporate and their respective officers, directors, employees and agents exclude liability for all loss (including loss of data, unauthorised access to data and consequential loss), damage, expenses, death or personal injury suffered or incurred arising out of, or in connection with, this competition (including in relation to the winners’ participation in this competition and use of the Prize).
  5. The National Portrait Gallery shall have no liability for any expenses incurred by entrants when entering the competition.
  6. Each entry must be in accordance with these Terms and Conditions and each entrant agrees to be bound by them. The Promoter may refuse to award a prize to entrants who fail to comply with these Terms and Conditions.
  7. Information provided to all entrants is accurate at the time of publishing and any changes will be updated on the Promoter’s website from time to time
  8. These Terms and Conditions are subject to Australian Capital Territory trade promotion and lottery laws and authorities.
Website use
  1. The Promoter cannot guarantee the continuous integrity of its servers. As a result, you may at times experience disruption or other difficulties in using the Promoter’s website. The Promoter has no liability for loss or costs of any kind you suffer as a result of or in connection with any disruption or other difficulties in using the Promoter’s website. The Promoter is not responsible for any failure of equipment or technical error associated with the competition. Or for any incorrect information, commission, interruption or delay in operation.
Privacy Collection Statement
  1. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter.
  2. The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at portrait.gov.au. You may request access or to update your personal information or lodge a complaint by writing to The Privacy Officer, at info@npg.gov.au.
Privacy Policy
  1. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social network. The entrant is providing information to the Promoter and not to any other party. The information provided will be used in accordance with the Privacy Policy of the National Portrait Gallery.
  2. IP (Internet Protocol) addresses (an IP is the address of a computer) of visitors are automatically logged by our servers. The server makes a record of your visit and logs limited information for statistical purposes – your IP address, top-level domain name (.com, .gov, .edu, .com.au etc), the date and time of your visit to our site, pages accessed and documents downloaded, previous site visited and the type of browser used. These logs are used to administer the website and to diagnose problems in order to be able to rectify them. This data is also used for audience research to help the Promoter to improve the site.
  3. IP addresses do not ordinarily contain any personally identifiable information and are aggregated for analysis. Such aggregate data may be used by the Promoter. Recording usage patterns helps us to identify popular areas of our site, and helps us to improve the site. Reports generated on aggregate data are periodically reported on as part of the Promoter’s internal governance.

  1. A cookie is a small file sent by the Promoter’s web server onto your web browser software when you access the Promoter’s website. Some parts of the Promoter’s website may use cookies to maintain contact through a session. The cookies allows us to recognise you as you move from one page of this website to another. The cookies that are used by the Promoter’s website do not collect any personal information and we do not combine information collected through cookies with other personal information to tell us who you are other than to authenticate the user for security purposes. This analysis is performed using data collected from the portrait.gov.au website and is used to improve the web experience of our users. Liability and Governing Law
  1. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’).
  2. In respect to this competition, except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any tax liability incurred by a winner or Entrant.
  3. The Competition is governed by the laws of Australian Capital Territory, Australia. Each entrant irrevocably agrees that the courts of the ACT shall have exclusive jurisdiction to hear and decide any suit, action or proceedings and/or to settle any disputes which may arise out of or in connection with this competition, and for these purposes, each entrant irrevocably submits to the exclusive and binding jurisdiction of the courts of the ACT.
